3. Intended Occupants
List every person who will reside in the dwelling, including minors. Do not ask for protected-class information such as race, religion, national origin, disability, sex, sexual orientation, or gender identity.
6. Screening & Legal Disclosures
Use consistent written screening criteria for all applicants. The criteria below match the criteria actually used by the property manager.
Tenant Selection Criteria
(In accordance with Texas Real Property and Housing rules and regulations, including Texas Property Code Chapter 92)
1. Application must be complete and accurate.
2. Income, rental history, credit history, and criminal history may be considered using lawful, consistently applied criteria.
3. Minimum income requirement: Gross monthly household income must be at least three (3) times the monthly rent.
4. Credit standard: No prior evictions or outstanding judgments related to housing. A minimum credit score of 600 is generally required.
5. Rental-history standard: No evictions in the past seven (7) years. Positive rental references from previous landlords are required.
6. Criminal-history standard: No convictions for violent crimes, drug manufacturing, or sex offenses. Other convictions are evaluated on a case-by-case basis in compliance with HUD guidelines and Texas law.
7. Other lawful screening requirements: All applicants 18 years of age and older must submit to a background and credit check.
8. Applications may be denied for failure to provide accurate or complete information or failure to satisfy the written criteria.
Owner/manager action required: Ensure these criteria match your actual written policies before publishing. Do not use criteria that discriminate against a protected class or operate as a proxy for one.
